On December 7, the State Administration for Market Regulation issued the Notification on Ad Examination of Drugs, Medical Devices, Health Food and Formula Food for Special Medical Use. The Notification indicated that the market regulation department of each province (district, city) shall pay more attention to this document in thought and action, especially in the period of institutional reform, further strengthen the organization and leadership of ad regulation, and properly conduct the ad examination of “San Pin Yi Xie” (namely, drugs, medical devices, health food and formula food for special medical use) in the region combining the new situation and new characteristics of the current advertising regulation.
We will further strengthen law enforcement in the ad regulation of “San Pin Yi Xie”, and strictly investigate and punish those publishing advertisements of “San Pin Yi Xie” that are not reviewed, not consistent with what has been reviewed or mendacious and illegal revealed through daily supervision, spot check monitoring, complaint report and media exposure.
To the market regulation departments of all provinces, autonomous regions, and municipalities directly under the Central Government:
According to the SMRA Regulations on Function Disposition, Internal Organization and Manning Quotas, the State Administration for Market Regulation is responsible for organizing and guiding the ad examination of drugs, medical devices, health food, formula food for special medical use. For efficient ad examination of “San Pin Yi Xie”, the related matters are hereby notified as follows:
I.Attach great importance to the ad examination of “San Pin Yi Xie”.
II.Conduct the ad examination of “San Pin Yi Xie” in accordance with law.
III.Strictly review the ads of “San Pin Yi Xie”.
IV.Regulate the ad examination of “San Pin Yi Xie”.
V.Optimize the ad examination of “San Pin Yi Xie”.
VI.Strengthen law enforcement in the ad examination of “San Pin Yi Xie”.
